When
Governor Gray got elected one day,
HMO patient rights he did betray.
Gray and the HMOs took them away,
'Cause patients did not have the cash to pay Gray.
We're
rightless,

Gray
and his henchmen concocted a plan.
They thought HMO patients had the mind of "Rainman."
So Gray hired a guy he called Director Dan,
A Governor Gray-type of government man.

Since
Rainman's addicted to game show TV,
Dan established a website for patients to see.
Spin the patient rights "Wheel of Fortune" for free,
But the wheel has been rigged; HMOs have the key.

Judge
Wapner is Rainman's authority source.
Danny impersonates Wapner, of course.
Your HMO marital rights he'll enforce.
Reality is
You and your rights he'll divorce.

Gray
Davis excelled at abolishing rights,
Corporations paid cash for his "Enforcement-Lite."
Campaign contributions for lax oversight
Means selling out patients in HMO fights.

Gray
forced Bob and Jackie to take him to court,
'Cause Dan's RICO enforcement of rights did extort.
When patients can set forth their rights with support,
Their remedy's always in contract and tort.

So
Gray masterminded their legal defense.
State predator lawyers an attack did commence.
They whined, and they lied, at taxpayer expense,
But a Court TV trial's in the near future tense.

Still
Governor Gray claims his right to recall,
Not just a few patient rights; Gray recalls all.
It's just Bob and Jackie to oppose Gray's tall gall,
'Cause Governor Gray plays HMO HARDBALL.

Gray's
bunker mentality has a soul-mate.
To "Tricky Dick's" style Gray Davis relates.
By recalling our rights, Gray should share Nixon's fate.
Integrity must be put first in our State!!!

INVIDIOUS
EVENTS
1998,
Governor Gray Davis' "Top Three Priorities" included:
"Implement
HMO reforms to protect the rights of all patients."
On
January 31, 2002,
Jackie requested that Governor Davis' Department of Managed Health Care
(DMHC) enforce her HMO patient rights according to its own California
Patient's Guide, posted on the home page of DMHC's website.
On
April 30, 2002,
Governor Davis' DMHC recalled Jackie's patient rights, refusing to force
her HMO to obey the law. The Senior Legal Counsel told her that she'd
have to sue to reclaim her rights. He wrote:
"In
order to determine the other remedies available to you, you may wish
to consult an attorney for more information."
On
October 11, 2002,
acting as her own attorney, Jackie sued the State of California for
recalling the patient rights Governor Davis enacted to protect her from
being victimized by her HMO.
On
December 20, 2002,
Governor Davis' DMHC lawyers stated that Jackie had no patient rights
whatsoever, breaking Governor Davis' 1998 promise to protect the rights
of all patients. They told a San Diego County Superior Court Judge:
"Mrs.
Finney
seeks declarations of purported rights
"
"
The
applicable statutes and regulations do not support Mrs. Finney's demand
for a meeting to discuss her legal rights
"
In
January, 2003,
the Department of Managed Health Care removed The California Patient's
Guide from its website to prevent patients from knowing about and enforcing
their legal rights.
On
February 20, 2003,
Judge Thomas P. Nugent ruled that Jackie's lawsuit for breach of contract
against the state may proceed to trial. This means that the Judge found
that patients can form legal agreements with the State of California.
The agreements can be enforced in court, when state officials and bureaucrats
violate patient rights.
